Quick answer
Your URS 401(k) and 457 plan balances are rollable; your URS pension is not
Utah Retirement Systems (URS) manages both defined-benefit pensions and separate savings accounts. The savings accounts (401(k), 457(b), and URS-administered IRAs) can transfer to a self-directed gold IRA when you leave employment or retire. The monthly pension check is an annuity with no individual account balance that can be moved. Tier 1 Noncontributory members have no personal contribution balance to refund because only the employer contributed to their pension account. Consult your tax advisor before any rollover decision.
How URS plans are structured
Utah Retirement Systems is the state agency administering retirement benefits for most Utah public employees: state workers, public school educators, local government staff, firefighters, and law enforcement officers. URS runs two fundamentally different categories of benefit that behave in opposite ways when a member considers moving assets elsewhere. Alabama teachers and state employees navigate a nearly identical two-tier structure; the RSA Alabama rollover guide breaks down what each category can move.
The pension systems pay a monthly lifetime benefit calculated from your years of service and final average salary. You do not own an individual account inside a pension; you hold a promise of future monthly income from the state. That promise cannot be packaged and transferred to another account type.
The savings plans work differently. URS offers a 401(k) Plan, a 457(b) Plan, a Traditional IRA, and a Roth IRA, all administered on behalf of members as separate, individually owned accounts. Every dollar in these savings plan accounts belongs to you and can be moved when you separate from employment.
Tier 1 versus Tier 2 membership
Members who joined a URS-covered position before July 1, 2011, generally belong to Tier 1, which includes two sub-systems depending on when they were hired and which system their employer participates in:
- Noncontributory System: The employer alone contributes to fund the pension. Members accumulate no personal contribution account with URS. When they separate from employment before reaching retirement eligibility, there is no member contribution balance available to refund or roll over.
- Contributory System: Both the member and the employer contribute toward the pension. Members who separate before meeting retirement eligibility can receive a refund of their own contributions (not employer contributions), which may then be rolled over to an IRA to preserve tax-deferred status.
Members who began a URS-covered position on or after July 1, 2011, are in Tier 2, a redesigned set of plans created to improve long-term sustainability:
- Tier 2 Hybrid System: Members receive a reduced defined-benefit pension plus a mandatory defined-contribution (401(k)-style) component funded by a portion of employer contributions.
- Tier 2 DC Only System: Some Tier 2 members elected to have the full employer contribution go into a 401(k) account rather than the pension. These members hold their entire employer-funded benefit in an individually owned 401(k), making it fully rollable at separation or retirement.
Confirm your specific plan membership by logging into your URS account at urs.org or calling URS directly. Individual hire dates, elections, and employer plan participation determine which tier and sub-system apply to you.
What is rollable from URS to a gold IRA
Under Internal Revenue Service rules, any eligible rollover distribution from a qualifying retirement plan can be transferred to a self-directed IRA. A self-directed IRA that holds IRS-approved physical gold or silver is commonly called a gold IRA or precious metals IRA. The following URS-administered accounts produce distributions that qualify for a rollover.
URS 401(k) Plan
The URS 401(k) is a qualified defined-contribution plan under IRC Section 401(a). When you separate from employment or reach the plan’s distribution age, the entire account balance (your own contributions, employer contributions, and investment earnings) is eligible to roll over to a traditional IRA, including a self-directed IRA holding physical gold. A direct rollover avoids the mandatory 20% federal income tax withholding that applies to indirect (check) distributions from 401(k) plans. IRS Publication 575 covers rollover rules for qualified plan distributions.
URS 457(b) Plan
The URS 457(b) is a governmental deferred compensation plan. Since the Taxpayer Relief Act of 1997, governmental 457(b) plans have been eligible to roll over to traditional IRAs. Upon separation from service at any age, the full 457(b) account balance can be transferred to a self-directed gold IRA. Read the section on the early-access trap below before committing to this path if you are under age 59½.
Tier 2 DC Only account
Members in the Tier 2 DC Only arrangement receive no defined-benefit pension accrual. All employer contributions flow into the individual 401(k) account instead. At separation or retirement, this entire balance, including both your contributions and the employer’s, is rollable under IRC Section 401(a). Tier 2 DC Only members typically hold the largest rollable pool of any URS membership category.
Tier 2 Hybrid DC component
Tier 2 Hybrid members carry both a reduced pension and a separate defined-contribution component. The DC portion (the individually owned 401(k) account) is rollable at separation. The pension portion is not. Your URS account statement shows both balances separately, so you can see exactly what is available to move.
Tier 1 Contributory member contribution refund
If you are a Tier 1 Contributory member who separates before reaching retirement eligibility, URS will pay out your personal contribution balance on request. That distribution is eligible for rollover to a traditional IRA within 60 days of receipt, or you can request a direct rollover to eliminate the withholding requirement. Only member contributions are refundable upon separation; employer contributions remain with URS to fund your future pension benefit.
URS-administered Traditional IRA
URS also offers a Traditional IRA as a savings vehicle. A Traditional IRA can be transferred to another custodian, including a self-directed IRA custodian specializing in physical precious metals, via a direct trustee-to-trustee transfer. A trustee-to-trustee transfer is not classified as a rollover under IRS rules and is not subject to the one-rollover-per-year limitation that applies to IRA-to-IRA indirect rollovers. IRS Publication 590-A explains the distinction.

What is not rollable from URS
The defined-benefit pension annuity
No URS pension system issues a lump-sum distribution to active members at retirement as a standard option. The pension pays a monthly annuity for life, with your elected survivor benefit option determining what happens after your death. Because there is no distributable lump sum, there is nothing to roll over to a gold IRA. Retirees already receiving monthly checks cannot reverse that election and move the underlying actuarial value into an IRA.
This is the most common misunderstanding among Utah public employees who ask about gold IRA rollovers: the pension is a promise backed by the state fund, not an account you own. IRS rollover rules under IRC Section 402 apply to account-based distributions. A stream of future monthly payments does not qualify. IRS Publication 590-A confirms that pension annuity payments cannot be rolled over. Union members in multiemployer pension plans hit the same wall; the union pension rollover guide explains what those arrangements actually allow.
Tier 1 Noncontributory System members on separation
If you are in the Tier 1 Noncontributory System and leave before reaching retirement eligibility, there is no member contribution refund because you never contributed personally to the pension fund. The employer funded everything. Your accumulated benefit takes one of two paths: it stays in place as a deferred vested pension payable when you reach retirement age, or you may forfeit it depending on your vesting years and URS rules. Either way, there is no lump sum to roll over from the pension account. Railroad employees covered by the RRB face a comparable structure; the railroad retirement rollover guide details what is and is not transferable.
If you also participated in the URS 401(k) or 457(b) Savings Plans independently of the pension, those accounts are entirely separate and remain rollable regardless of which pension sub-system you belong to.
Required Minimum Distribution amounts
Once you are subject to Required Minimum Distributions from any IRA or former employer plan account, the RMD amount for the current year must be distributed as a taxable withdrawal before any remaining balance can be rolled over. You cannot roll an RMD into another IRA. This rule applies under IRC Section 401(a)(9) regardless of the source account. Consult your tax advisor for your specific situation regarding RMD timing and amounts.
The 457(b) early-access trap when rolling to an IRA
Government 457(b) plans carry a significant advantage over 401(k) plans for people who separate from service before age 59½: there is no 10% additional tax on distributions, regardless of your age at separation. That flexibility disappears permanently the moment you roll the 457(b) into a traditional IRA.
Inside a traditional IRA, the money is governed by IRA early-distribution rules, which apply the 10% additional tax under IRC Section 72(t) on taxable distributions before age 59½, with limited exceptions. If you are under age 59½ and need access to some of your 457(b) funds in the near term, a rollover converts penalty-free assets into potentially penalty-subject ones.
Two strategies address this:
- Partial rollover: Take the portion you need as a direct 457(b) distribution (penalty-free) and roll the remainder to the gold IRA. You can split the distribution, but IRS withholding rules still apply to the portion paid to you from a 457(b) plan.
- Delay the rollover: Leave the 457(b) with URS until you no longer need penalty-free access, then roll the full balance.
For members age 59½ or older, this distinction does not affect the rollover decision. For a deeper look at how government 457 rollovers work across plan types, see our guide on 457(b) to gold IRA rollovers for government employees. Consult your tax advisor for your specific situation before splitting or timing any distribution.
How the rollover process works
A rollover from a URS savings account to a self-directed gold IRA follows the same sequence as any qualified plan rollover. Plan for several weeks of administrative processing time across multiple parties.
- Open a self-directed IRA with an IRS-approved custodian. Standard brokerage IRA custodians do not hold physical metals. You need a custodian that specifically offers self-directed IRAs for alternative assets. The IRS requires that IRA assets be held by a qualified trustee or custodian under IRC Section 408(a) or (h).
- Request a direct rollover from URS. Contact URS and ask for a direct rollover to your new custodian. In a direct rollover, URS sends funds straight to the new custodian; the check is made payable to the custodian for the benefit of your account, not to you personally. This avoids the mandatory 20% federal income tax withholding that triggers on distributions made payable to the account holder under 401(k) rules.
- Purchase IRS-approved precious metals. Once funds arrive at the new custodian, you direct the purchase of eligible metals. Under IRC Section 408(m)(3), gold must be at least 99.5% pure (with a statutory exception for American Gold Eagle coins, which are approved by law despite lower gold fineness). Silver requires 99.9% fineness; platinum and palladium require 99.95%. Coins and bars must meet additional production requirements set by the IRS.
- Arrange storage at an IRS-approved depository. Physical metals held in an IRA cannot be stored at your home or in a personal safe-deposit box while inside the IRA. IRS regulations require storage at an approved depository. Your custodian will typically facilitate this relationship.
If URS issues you a check payable to you rather than your new custodian (an indirect rollover), you have 60 calendar days from the distribution date to deposit the full pre-tax amount, including the 20% that was withheld, into a qualifying IRA using your own funds to cover the withheld portion. Missing the 60-day window converts the entire distribution to taxable income. IRS Revenue Procedure 2016-47 provides a self-certification process for certain hardship situations, but it is not a general deadline extension. A direct rollover eliminates this risk entirely.

Utah retirement income tax and credits
Utah taxes most retirement income, including IRA distributions, 401(k) distributions, and pension income, as ordinary income at the individual income tax level. Utah has moved to a flat income tax structure; check the current rate at the Utah State Tax Commission (incometax.utah.gov), since the legislature has adjusted the rate in recent sessions.
Utah retirement tax credit
Utah provides a nonrefundable retirement tax credit for eligible taxpayers. The credit is available to residents who are age 65 or older, or who receive qualifying disability income. The credit amount phases out as income rises above certain thresholds set by the state legislature. The credit reduces Utah income tax owed, but cannot produce a refund if it exceeds your liability.
Rolling a URS savings account into a traditional gold IRA does not trigger Utah income tax at the time of the transfer if it is done as a direct rollover. Utah income tax applies when you take distributions in retirement, at the same rate that applies to other ordinary income. Roth IRA distributions, if properly qualified, are generally not taxable at the federal level; Utah conforms to federal Roth IRA rules for most purposes, but verify current conformity with your tax preparer.
Social Security income is taxable in Utah above certain income thresholds, following the federal treatment. This matters for retirement income planning because taxable Social Security plus IRA distributions can combine to push income above the retirement credit phase-out range. Consult your tax advisor for your specific situation.

Who this makes sense for (and who it does not)
Adding physical gold to a retirement account involves real custodian and storage fees, reduced liquidity compared to ETFs or mutual funds, and the need to coordinate across multiple parties. Here is an honest breakdown of situations where a URS-to-gold-IRA rollover is more or less likely to fit your circumstances.
More likely to fit
- You have a meaningful URS savings plan balance and are at or near retirement. Larger balances spread fixed annual custodian and storage fees across more assets, reducing their proportional drag on performance.
- You are a Tier 2 DC Only member. Your entire employer-funded benefit lives in a rollable 401(k), giving you a larger pool to work with than members who carry only a pension promise.
- You have income sources in retirement beyond the rollable account. A pension check, Social Security, or other savings that cover living expenses reduces your dependence on the gold IRA for short-term cash, making the reduced liquidity less of a concern.
- You have made an independent decision to hold physical metals. A licensed financial advisor can help you evaluate what portion, if any, fits your overall retirement picture. We are not financial advisors and do not make allocation recommendations.
Less likely to fit
- You are a Tier 1 Noncontributory member with no savings plan accounts. Your URS-sourced rollable assets may be limited or absent. Evaluate whether any outside-URS retirement accounts (403(b), personal IRA, former employer 401(k)) represent the more practical starting point.
- Your rollable balance is small. Annual custodian administration fees and depository storage fees typically run $150 to $300 or more per year depending on the custodian. On a small balance, those costs consume a disproportionate share of assets. Ask any prospective custodian for a complete fee schedule before opening an account.
- You need liquidity in the near term. Selling metals held in an IRA requires a taxable distribution, takes administrative time, and involves transaction costs. Physical gold is not a substitute for accessible cash or liquid investments in a retirement portfolio.
- You are under 59½ and rolling a 457(b) only. You would permanently lose the 457(b)’s penalty-free early-access benefit once the funds enter an IRA. If you need that flexibility, discuss the trade-off with your financial advisor before proceeding.
Companies Utah retirees ask about
A gold IRA requires an IRS-approved self-directed IRA custodian to hold the account and a precious metals dealer to source the physical metals. These are two separate business relationships. The custodian provides the IRA structure; the dealer facilitates the purchase and sale of the metals.
Augusta Precious Metals is one company that Utah public employees frequently research when exploring gold IRAs. Augusta has been in operation since 2012 and holds a BBB A+ rating with accreditation dating to 2014. The company emphasizes an education-first approach: prospective customers speak one-on-one with a salaried, non-commissioned educator before making any decision, with no obligation to proceed. Augusta has been recognized by Money Magazine as Best Overall Gold IRA Company from 2022 through 2026 and by Investopedia as Most Transparent Gold IRA Company from 2022 through 2026.
Based on industry-reported figures, Augusta works with clients who have approximately $50,000 or more in qualifying retirement account balances. If your URS 401(k) or 457(b) meets or exceeds that range, you can request a free information guide from Augusta to learn more about how their process works before making any commitment.
Our methodology for covering companies is identical for every company we review, independent of any commercial relationship. We are not financial advisors. Can I roll my URS pension into a gold IRA?
No. A URS defined-benefit pension pays a monthly annuity and has no distributable account balance. IRS rollover rules apply to account-based distributions, not future income streams. Only the savings plan accounts (401(k), 457(b), and URS-administered IRAs) hold individual account balances that qualify for a rollover to a self-directed gold IRA.
I am a Tier 1 Noncontributory member. Do I have anything to roll over from URS?
Not from your pension account, because you made no personal contributions to it. However, if you separately enrolled in the URS 401(k) or 457(b) Savings Plans, those account balances belong to you individually and can be rolled over to a gold IRA. Log in to your URS account at urs.org to confirm which accounts you hold and their current balances.
What is the difference between a direct rollover and a 60-day rollover from URS?
In a direct rollover, URS transfers funds straight to your new IRA custodian. You never receive a check, no 20% withholding applies, and there is no deadline to meet. In a 60-day (indirect) rollover, URS sends you a check, withholds 20% for federal taxes on 401(k) distributions, and you must deposit the full original amount (including the withheld 20%, covered from other funds if needed) into an IRA within 60 calendar days. A direct rollover is simpler and removes both the withholding and the deadline risk entirely.
Does Utah tax the rollover when I move my URS 401(k) to a gold IRA?
A properly executed direct rollover is not a taxable distribution and is not subject to Utah income tax at the time of transfer. Utah income tax applies when you take distributions from the gold IRA in retirement, at whatever flat rate applies at that time. A retirement tax credit may reduce your Utah tax liability depending on your age and income level. Consult your tax advisor for your specific situation.
I rolled my URS 457(b) to an IRA. Can I still take money out before age 59½ without penalty?
No. The 10% additional tax exemption that applies to governmental 457(b) plan distributions taken after separation from service does not carry over into an IRA. Once inside a traditional IRA, distributions before age 59½ are subject to the 10% additional tax under IRC Section 72(t) unless a specific statutory exception applies. If penalty-free early access is important to you, discuss your options with a tax advisor before completing the rollover.
How long does a URS rollover to a gold IRA take?
Processing times vary across parties. Opening the self-directed IRA typically takes a few business days. URS processes outgoing rollover requests according to its own administrative timeline; contact URS directly for current estimates. Once funds arrive at the new custodian, the metals purchase and depository transfer can proceed. Four to eight weeks is a reasonable range to plan for from start to metals delivered at the depository, though timing depends on each party’s processing speed.
What metals are IRS-approved for a gold IRA?
Under IRC Section 408(m)(3), eligible gold must be at least 99.5% fine or specifically listed in the statute (American Gold Eagle coins are permitted by statute despite lower gold fineness). Silver requires 99.9% fineness; platinum and palladium require 99.95% fineness. All bars and coins must meet production requirements set by the IRS, typically meaning they were manufactured by a national government mint or an accredited refiner. Your custodian is responsible for verifying eligibility before purchase.
Can I do a Roth conversion when rolling my URS 401(k) to a gold IRA?
You can roll a pre-tax URS 401(k) into a Roth self-directed IRA (a Roth gold IRA), but the converted balance counts as ordinary taxable income in the year of conversion at both the federal and Utah state levels. Whether this makes sense depends on your current tax bracket compared to your expected rate in retirement, your time horizon, and other factors specific to your situation. Consult your tax advisor before pursuing a Roth conversion with a large account balance.
Does Tier 2 Hybrid membership mean I can roll over both my DC and pension portions?
No. Only the defined-contribution (DC) component is an individually owned account with a rollable balance. The Tier 2 Hybrid pension portion follows the same rule as Tier 1 pensions: it is a defined-benefit promise that pays monthly income at retirement and has no distributable lump sum. Your URS account statement separates the two, so you can see your DC balance independently of your accrued pension benefit.
